RE: The tariff classification of dried prunes from Italy

Dear Ms. Williams:

In your letter dated June 8, 2012 you requested a tariff classification ruling on behalf of Italian Quality Standards, Inc.

The merchandise is described as containing 87 percent prunes and 13 percent water, rehydrated, pasteurized and packaged.

The applicable subheading for the dried prunes will be subheading 2008.99.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for fruit, nuts and other edible parts of plants, otherwise prepared or preserved…not elsewhere specified or included…other…other…plums (including prune plums and sloes). The rate of duty will be 11.2 percent ad valorem.

This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA). This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
